TreeTalk Node — End User License Agreement (EULA)

This End User License Agreement (“Agreement”) is a legal contract between you (“User”, “You”) and TreeTalk (“TreeTalk”, “We”, “Us”, “Licensor”) regarding your use of TreeTalk Node (“Software”).
By downloading, installing, accessing, or using the Software, you agree to be bound by the terms of this Agreement. If you do not agree, do not install or use the Software.
1. License Grant
1.1 Freemium License
For users of the Free / Freemium version, TreeTalk grants a revocable, non-exclusive, non-transferable license to:
- Use the Software on any number of personal or company-owned Windows PCs.
- Distribute the original, unmodified installer, provided the Software is distributed as-is, without modification, and TreeTalk’s names or trademarks are not used in a misleading way.
You may not:
- Modify, translate, reverse-engineer, decompile, or disassemble the Software.
- Circumvent any technical limitations or restrictions.
- Use TreeTalk trademarks or logos without written consent.
By using a free or freemium version of the Product, the User agrees that its use, or the use of certain features, may be subject to additional conditions, including registration with the provision of an e-mail address, subscription to newsletters, receipt of promotional messages both via e-mail and within the software product itself, and participation in surveys and beta testing.
1.2 Paid / Premium License
For paid plans (Premium, Premium Offline, Enterprise), TreeTalk grants a revocable, non-exclusive, non-transferable license to install and activate the Software on one (1) specific PC per license key.
During activation, a non-reversible hardware fingerprint is generated and associated with the license key. A license key may not be used on more than one specific PC.
You may not:
- Share, resell, rent, or sublicense the Software or license key.
- Use the same license key on other PCs, on multiple PCs, or on the same PC if it has undergone upgrades or changes to its core hardware characteristics to the extent that the computer’s fingerprint has changed.
- Attempt to remove or bypass the hardware fingerprinting or activation process.
- Modify, reverse-engineer, decompile, or disassemble the Software.
2. Ownership
The Software is licensed, not sold. All rights, title, and interest in and to the Software, including all intellectual property rights, remain with TreeTalk and its licensors.
3. Restrictions
You agree not to:
- Use the Software in violation of any applicable law or regulation.
- Use the Software for hosting or providing services to third parties without prior approval.
- Create derivative works based on the Software.
- Remove or alter any proprietary notices, labels, or marks within the Software.
4. Privacy
TreeTalk Node is designed to operate primarily within local networks. The Software does not send user files or chat messages to TreeTalk servers. Some metadata may be processed for activation, diagnostics, or support. Details are described in the Privacy Policy and Privacy Addendum for enterprise clients.
5. Updates and Support
TreeTalk may provide updates, patches, or enhancements to the Software. Such updates may be installed automatically or made available for manual installation. The User’s right to receive updates and upgrades depends on the type of license. Updates and bug fixes explicitly marked as such mandatory are considered mandatory and have priority for installation by Users. Failure to install these updates releases TreeTalk from any responsibility related to the use of outdated versions of the Products.
The User’s right to receive support in connection with the use of the Products depends on the type of license.
In general, users of free versions of the Products are entitled to access the knowledge base, a dedicated technical support and troubleshooting page, as well as community-supported user blogs.
Users holding paid licenses are entitled to support via direct inquiries, e-mail, and ticket-based support (in addition to the support methods available under the free license)
6. Warranty Disclaimer
THE SOFTWARE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7. Limitation of Liability
To the maximum extent permitted by law, TreeTalk shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or related to your use of the Software.
In any case, TreeTalk’s total liability shall not exceed the amount actually paid by you for the license within the two (2) months preceding the event giving rise to the claim.
8. Termination
This Agreement is effective until terminated. It may be terminated by TreeTalk if you fail to comply with any term of this Agreement. Upon termination, you must cease all use of the Software and destroy all copies in your possession.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where TreeTalk is headquartered, without regard to its conflict of law principles.
